OVERVIEW

By using the Uniform Dating UK service you are indicating that you agree to be bound by all of the terms and conditions in this Agreement. Please print and keep a copy of this Agreement for your records. If you do not accept this Agreement, do not use the Uniform Dating UK service.
This Service Membership Agreement (the "Agreement") is made by NSI (Holdings) Ltd t/a Uniform Dating UK, a UK registered company No.5236118 and registered for VAT No.855 9741 75 ("Uniform Dating UK") and you, as user of the Uniform Dating UK service.

CHANGES TO THE SERVICE

Uniform Dating UK reserves the right to change, modify, add or remove portions of this Agreement at any time and may add to, change, suspend or discontinue any aspect of the Service at any time. In either such case Uniform Dating UK will notify Members via e-mail, newsletter or the Uniform Dating UK Website of such changes by posting a revised Agreement on the website, which you can access at any time using the "Terms and Conditions" link on www.uniformdating.com. Your continued use of our service after notification of such a change shall be deemed to constitute acceptance by you of any such changes, modifications, additions or deletions. You agree to review this Agreement periodically to be aware of any such revisions.

ELIGIBILITY

You must be eighteen or over to register as a member of
http://www.uniformdating.com or use the services made available. Membership of the Service is invalid where it has been prohibited. By using Uniformdating.com and it's services, you represent and warrant that you have the right, authority, and capacity to enter into this Agreement and to abide by all of the terms and conditions of this Agreement. You also represent and warrant to Uniform Dating UK that you will use Uniform Dating and it's services in a manner consistent with any and all applicable laws and regulations.

REGISTRATION AND MEMBERSHIP

You may become a member of the Service at no cost by visiting www.uniformdating.com and completing the 'Join for free' process. By completing the 'Join for Free' process and registering with Uniform Dating UK you are agreeing to be bound by these terms and conditions. As a member you will have the ability to participate in some, but not all, of the features and services
available within the Service. In order to access additional features and services, including the ability to communicate with other members on a personal basis, you must become a paying subscriber to the Service. Please see the upgrade page of your profile for details of the current continuous service rates. To terminate your membership, go to http://www.uniformdating.com login and go to "My Profile" and select "My Account" where you will find instructions to cancel your Uniform Dating subscription. Once you have cancelled your subscription you will be able to remove any personal details held by Uniform Dating UK via the "My Account" section of your profile also.

RECURRING BILLING

By entering into this agreement you agree that any subscription payments to the Service may consist of an initial period, for which there is a one time charge, followed by recurring periodic charges which you choose, excluding uniformdating.com "TEXT PAY" service. All recurring charges shall remain active and your account will continue to be billed according to your subscription choice until you cancel your subscription. In cases where your payment card is due to expire within 14 days of a subscription payment being due, we will take the payment immediatley prior to the cards expiry in order to allow your subscription to continue without interuption. All subscriptions are periodically calculated by calendar date.

You agree that by having a paid subscription to Uniform Dating and its services uniformdating.com will continue to bill you until you cancel your subscription. Having a subscription means Uniform Dating UK may submit periodic charges without further authorisation from you. Attempts to send any overdue payments will continue until the sufficient funds are available. Uniform Dating UK reserve the right to alter the membership status of any account whilst investigating the validity of the payment card.

We have the right to change the subscription fee at any time but, will give reasonable notice if the change directly affects your membership/subscription, by posting a link to the amended prices within these terms and conditions 14 days before the changes are applied. By using UniformDating.com you agree to review the terms and conditions periodically and make yourself aware of such changes.

New price change with affect from 08/06/11. Changes will be as follows:

5 Day Subscription: £9.99
1 Month Subscription: £19.99
3 Month Subscription: £34.99

PRIVACY OF FINANCIAL INFORMATION

Uniform Dating UK will not share your financial information with third-parties, except as necessary to process your payment. By providing your credit card details to us, you consent to and authorise us to provide your credit card details to such credit card processors and financial institutions as are necessary to process your payment and to store your card details to facilitate your future payments.

TERM AND TERMINATION

By becoming a member of Uniform Dating UK, you are electing to commence the service of the website with immediate effect. This waives any right, from any law, to make use of a capability known as 'the cooling off' period, which allows you a period of time to postpone the commencement of the service. You may change or cancel your authority for Uniform Dating UK to continue with recurring billing at anytime, by calling the membership team on 01737 648434, Monday-Friday between 09:00 - 17:00. This excludes public/bank holidays - if you wish to cancel your subscription during this period please ensure you call the office during the above hours before this holiday period begins. No pro-rata refunds will be issued to you if you should choose to cancel your subscription but full membership benefits will still be available until your current subscription expires. Giving notice of your cancellation will not affect charges submitted before Uniform Dating UK could reasonably act to cancel your subscription.

Cancellation of a subscription will cancel future payments not payments that have already been processed. Your full membership will remain active until the end of the current paid period. Uniform Dating UK reserves the right to immediately suspend or terminate your access to the service, without notice and without refund upon any breach of this Agreement by you, which may be brought to our attention.

If your subscription is up for renewal and we are unable to charge your credit/debit card or paypal account for any reason, we may discontinue your membership temporarily until we receive your next subscription payment. We reserve the right to continue to make attempts to bill you, as per the 'recurring billing' section of these terms and conditions (above) until you cancel your subscription with Uniform Dating UK using the correct cancellation procedure.

You are free to remove your personal details including information held by the Uniform Dating team, information included in your public profile and messages sent to you within the site at anytime, provided you do not have an active subscription (if you do, you will need to call the membership team on 01737 648434 who can cancel the subscription and then remove all details for you). To remove your profile and details from the site telephone the membership team on 01737 648434, email help@uniformdating.com or log into your profile at www.uniformdating.com click 'My Profile' then 'My Account' and follow the prompts at the bottom of the window 'How do I delete my membership'.

ACCEPTED USE OF THE SERVICE

You shall not provide, promote, distribute, place or otherwise publish as a Member of the service any content, or profile that includes content, which is libellous, defamatory, obscene, pornographic, abusive, and fraudulent or violates any law. Uniform Dating UK can and will review and or delete any material deemed as offensive, commercial, inappropriate, harmful or slanderous to this site or anyone else within profiles, photo's or messages.

As Uniform Dating UK may not review all information provided by You, You shall remain solely responsible for your profile content.

Uniform Dating UK reserves the right to deem any profile inappropriate and terminate any membership of Uniform Dating UK. If you are terminated from the Service, Uniform Dating UK will not refund any unspent subscription for the Service.

CONTENT POSTED ON THE SITE

All information posted on Uniform Dating UK will be deemed as non confidential and non proprietary. We hold no obligations to such material, and are free to copy, disclose, distribute and incorporate all text, sound and images for all global commercial and non commercial purposes. Such content may also be used in our online marketing campaigns. This pertains to, but is not limited to all information gained from registered members through the process of the membership sign up to the company, the information and images included in their profiles and the facilities and services provided on the website.

We may (directly or through our partners) distribute, publish or broadcast the information contained in your profile (including images and video), personal ad and search criteria to third parties including via email newsletters, on third party websites or via any other distribution media including electronic media (such as email, SMS, MMS, WAP, Internet, CD-Rom or DVD-Rom), and audiovisual communications media (including press, radio, analogue television, digital television, cable or satellite). You have granted us a licence to do this by agreeing to our terms and conditions and becoming a member of Uniform Dating UK. If you no longer wish us or our partners to distribute, publish or broadcast such information, you can terminate your registration with us by following the instructions in the designated part of our site. Such termination will not affect any previous distribution, publication or broadcast of the relevant material and will only take effect upon the next update or version thereof.

You shall not under any circumstances include in your member profile - URL's, last names, addresses, e-mail addresses, or text that is suggestive of an e-mail address, URLs, or any other links to alternative websites that contain information about you, or information available relating to the contact of you.

You may not advertise for functions, parties or events of any kind created for networking within the Uniform Dating site. Advertising an event as an 'Official Uniform Dating' party or other event without the authorisation of Uniform Dating UK is strictly prohibited.

ACCOUNT SECURITY

You are responsible for maintaining the confidentiality of the login email and password that you designate during the registration process with the Service, and You are fully responsible for all activities that occur under your login email and password. You agree to (a) immediately notify Uniform Dating UK of any unauthorised use of your username or password or any other breach of security, (b) ensure that you exit from your account at the end of each session and (c) keep your login details personal to you. Only the account holder is allowed to use your profile; lending your logon to third parties will result in your account being put on hold due to the security breach. Likewise, a profile is for one person only, by agreeing to these terms and conditions you agree that each profile is for one person. If the Uniform Dating Team suspect that more than one member is using a profile this profile will be placed on hold until one account holder can be established and any payments made during this period will not be refunded.

Uniform Dating UK will not be liable for any loss or damage arising from your failure to comply with these provisions. You should use particular caution when accessing your account from a public or shared computer so that others are not able to view or record your password or other personal information. If you share your computer with others, it is best practice to disable your "remember me" feature. You must only subscribe to your RSS FEED on a private computer and for your own security. It is not good practice to subscribe to your RSS FEED on a PUBLIC or SHARED computer.

Uniform Dating UK shall not be held liable for false declarations made by a Member. It is imperative that Members take precautions when arranging to meet up with another Member. Uniform Dating UK shall not be held liable for any consequences of meetings between Uniform Dating Members, on UniformDating.com or during meetings between it's Members and/or non-Members as a consequence of the use of the website and Services. On a first date, it is recommended that you tell someone close to you where you are going and choose to meet your date in a public place.

NON COMMERCIAL USE BY MEMBERS

You will not, within your profile, through the messaging service or anywhere within UniformDating.com, request money or make any requests or references to a maintenance agreement or any type of financial arrangement of any kind. Requesting money from other members is strictly prohibited and will result in your profile being removed from the site, your subscription cancelled and you being banned from the site. Any subscription payments made will not be refunded.

Uniform Dating UK and its services are for the personal use of individual members only and may not be used in connection with any commercial ventures. Organisations, companies, and/or businesses may not become members and should not use the Service or the Website for any purpose. Illegal and/or unauthorised uses of the Website, including collecting names and/or email addresses of members by electronic or other means for the purpose of sending unsolicited email and unauthorised framing of or linking to the Website will be investigated, and appropriate legal action will be taken, including without limitation, civil, criminal, and injunctive redress.

PRIVACY OF DATA

Our technical team does their utmost to ensure the safety and security of Uniform Dating UK's systems. Should a security breach occur we will endeavour to act as fast as possible to remedy the problem. In line with current Data Protection regulations you can access or request access to information concerning yourself in order to have it modified, deleted or to forbid any further use by Uniform Dating UK. You can, at any time from your registration, request to receive/to cease to receive Uniform Dating newsletters, promotional offers sent via email/mobile phone - to turn off emailed notifications please log into UniformDating.com and click 'My Profile' then 'My Account' and select/deselect the emails you would/would not like to receive.

MONITORING OF INFORMATION

We reserve the right to monitor all advertisements, public postings, chat room conversations and messages to ensure that they conform to applicable content guidelines, the terms and conditions of Uniform Dating UK and the rules of the chat room. These guidelines are monitored by us and subject to change from time to time.

EXTERNAL LINKS

The Service may from time to time contain links to other Internet sites and resources ("External Links"). You acknowledge that we are not responsible for the content of such sites, and have no liability as a result of the availability of External Links or their contents. We suggest that you review the terms of use and privacy statements of such External Links prior to using them.

REMOVAL OF INFORMATION

While we do not and cannot review every message, chat history or other material posted or sent by users of the Service, and are not responsible for any content of these messages or materials, we reserve the right, but are not obligated, to delete, move, or edit messages or materials, including without limitation profiles, images, public postings and messages, that we, in our sole discretion, deem to violate these terms and conditions or any other applicable content guidelines, or to be otherwise unacceptable. You shall remain solely responsible for the content of profiles, public postings, images, messages and other materials you may upload to the Service or users of the Service.

TERMINATION OF ACCESS TO THE SITE

This Agreement shall remain in effect until terminated. Upon termination, you shall no longer be entitled to use the Service. Your account may also be deleted if we are unable to get in touch with you by email. Please ensure that you have a valid email address registered with us at all times. Reasonable efforts will be made on the part of Uniform Dating UK to contact you if Uniform Dating UK has to contact you. If however, you are not reachable, your Membership account will be cancelled and any unspent subscription will not be refunded. We reserve the right to terminate your membership if you have breached these terms and conditions.

PROPRIETARY RIGHTS IN CONTENT ON UNIFORMDATING.COM

Uniform Dating UK owns and retains all proprietary rights in the Website and the Service. The Website contains the copyrighted material, trademarks, and other intellectual property and proprietary information of Uniform Dating UK, and its licensors. Except for that information which is in the public domain or for which you have been given written permission, you may not copy, modify, publish, transmit, distribute, perform, reproduce, license, create derivative works from, transfer display, or sell or re-sell any such intellectual property or proprietary information.

TRANSFER OF INFORMATION TO SELECTED THIRD PARTIES

By using the Uniform Dating UK service you explicitly authorise Uniform Dating UK to transfer the information you have provided to us and the benefits of the above mentioned rights to selected third parties and the eventual successors of UniformDating.com.
If you no longer wish for Uniform Dating UK, its partners or successors to reproduce or broadcast the information comprised in your personal ad, your search criteria, or your profile, you can terminate your account following the conditions in the "Term and Termination" section (above).

LIMITED WARRANTY

The Service, its use and the results of such use are provided "as is." To the fullest extent permissible pursuant to applicable law, Uniform Dating UK disclaims all warranties expressed or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose, in relation to the service, its use and results of such use. Without limiting the foregoing, Uniform Dating UK specifically disclaims any warranty (A) That the service will be uninterrupted or error-free, (B) that defects will be corrected, (C) that there are no viruses or other harmful components, (D) that the security methods employed will be sufficient, or (E) regarding correctness, accuracy, or reliability. Applicable law may not allow the exclusion of implied warranties so the above exclusion may not apply to you.

LIMITATION OF LIABILITY

Uniform Dating UK or its suppliers or resellers shall not be liable to you or any other person for (A) any direct, special, incidental or consequential damages of any character arising out of the use or inability to use the Uniform Dating UK service or any information provided on the Uniform Dating UK website or any other hyper linked website. Including, without limitation, damages for loss of goodwill, any lost profits, business interruption, loss of programs or other data on your information handling system or otherwise, even if Uniform Dating UK or a Uniform Dating UK authorised representative has been advised of the possibility of such damages or (B) any claim attributable to errors, omissions or other inaccuracies in the website or any hyper linked website. All parties are bound to the jurisdiction of the English Courts for the settlement of any disputes or claims that arise from participation in this service or in connection with this agreement.
